Welcome to GiftPot. These Terms and Conditions ("Terms") govern your access to and use of the GiftPot mobile application and website (collectively, the "Service"), operated by HackWeb ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By creating an Account, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.
To use certain features of the Service, you must create an Account using a valid email address. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use.
Creators may create Pools for legitimate gift-giving purposes. By creating a Pool, you agree that:

All payments are processed securely through Stripe, our third-party payment processor. By making a Contribution or receiving a Payout, you also agree to Stripe's Terms of Service.
We may charge a platform fee on Payouts. Any applicable fees will be clearly disclosed before a Pool is created and before a Payout is initiated. Fee amounts and structure may change; we will notify you of material changes.
To receive Payouts, Creators must complete Stripe Connect onboarding, including identity verification. Payouts are subject to Stripe's processing times and policies. We are not responsible for delays caused by Stripe or your financial institution.
Refunds may be issued at our sole discretion in cases of fraud, technical error, or other exceptional circumstances. Contributions to completed Pools that have been paid out are generally not eligible for refund.
The Service, including its design, code, content, logos, and trademarks, is owned by HackWeb and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
By submitting content (such as Pool descriptions, messages, or images) to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the Service.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.
You are solely responsible for all content you submit to the Service. We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice. We may also suspend or terminate Accounts that engage in prohibited conduct.
Pools have a deadline set by the Creator. After the deadline, a Pool is marked as expired and no further Contributions can be made. Creators may still request Payouts for funds collected before expiration, subject to our policies.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, HackWeb and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.
Our total liability to you for any claim arising from or relating to the Service shall not exceed the amount of fees paid by you to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless HackWeb and its affiliates from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your Account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including indemnification, limitation of liability, and intellectual property) shall survive.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through in-app notifications or email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of laws provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of Italy.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and HackWeb regarding the Service and supersede all prior agreements.
